• The company ORFEVRERIE CHRISTOFLE, a Société par Actions Simplifiée [simplified joint stock company] with share capital of 2,550,000 euros, registered with the Trade and Companies Register of Paris under number 562 063 263, with headquarters located at 9 Rue Royale, 75008 Paris, France, acting on its own behalf as well as on behalf of the other companies in the group (hereinafter called the “Organizing Company”) is organizing a promotional competition (hereinafter called the “Contest”) on its USA-based website, accessible at the following web address: https://www.christofle.com/us_en/. The Contest shall run from May 25, 2020 at 5:00 p.m. EST through June 7, 2020 at 12:00 a.m PST. The Organizing Company reserves the right to modify the dates mentioned above if circumstances of Contest management so require.

 

1/ CONCEPT

To enter the Contest, each entrant must complete the Contest registration form on one of the Organizing Company’s websites, accessible at the following web address: https://www.christofle.com/us_en/. On the said form, the entrants must fill in their Surname, Given name, and Email address, and provide an explanation about who their "Hero" (an essential worker) is and why in response to, "Who is your hero?"From among the entries, the Organizing Company, in conjunction with independent judges, shall select one response in English that best match the values of Christofle.

By sole virtue of their participation in the Contest, the entrants expressly authorize the Organizing Company to share the winning response (along with the given names of the winner) on its Facebook and/or Instagram page, https://www.instagram.com/christofle/?hl=fr, which does not give the winner the right to any additional reward, compensation, or benefit other than any prizes that they have won in the context of the Contest.

 

2/ DURATION

The Contest shall run from May 21, 2020 at 5:00 p.m. EST through June 7, 2020 at 12:00 a.m PST.

Any and all entries recorded by the Organizing Company after June 7, 2020 at 12:00 a.m PST shall be disregarded.

 

3/ NUMBER OF WINNERS

One winner from among the entrants shall be named by the Organizing Company, in conjunction with the independent judges.

The one winner shall be notified via email. In the event that the winner fails to respond within ninety-six (96) working hours of the winner notification message, the prizes shall revert to the Organizing Company. No message shall be sent to non-winners. If the contact information provided by the entrants is insufficient for the Organizing Company to notify the winner of their prize, the said winner shall be disqualified and shall lose the benefit of their prize, and the Organizing Company shall not be required to pay any allowance or compensation of any sort.

The prize shall be sent to the winner via postal mail with tracking. The delivery address must be sent by the winner to the Organizing Company via email.

All employees and agents of the Organizing Company and of its partner companies, all individuals involved in the organization and fulfillment of the Contest, and their family members are ineligible to enter the Contest.

 

4/ PRIZE

The winner shall receive the following prize:

- an UNI silver-plated trinket tray US $325 (Christofle recommended retail price in the USA, inclusive of all taxes, May 2020). If the UNI silver-plated trinket tray US $325 is sold out, an alternate prize will be selected and given.

The prize is not eligible for exchange or return, nor may it be replaced with financial compensation or the monetary equivalent of the prize. No change may be requested from the Organizing Company for any reason. It is hereby specified that the Organizing Company shall not provide any insurance or customer assistance, as the prize consists solely of the delivery of the intended prize for the Contest. Any claims regarding the delivery of the prize must not consist of a request for financial compensation or the monetary equivalent of the prize.

The winner expressly acknowledge that the Organizing Company accepts no liability for any incidents or damage of any kind that may occur as a result of enjoyment of the prize awarded and/or the use thereof.

 

5/ ENTRY

Any entry that is incomplete, fails to comply with these rules, or is submitted after the closing date of the Contest shall be considered null and void and shall entail the elimination of the entrant.

Any natural person of legal age as of the date of entry and residing in Europe or the United States is eligible to enter the Contest, free of charge and with no purchase necessary. The entry is non-transferable and is limited, for the entire duration of the Contest, to one entry per person (same surname and given name) and per household (one email address and one postal address corresponding to an entry). It is therefore forbidden to enter under multiple aliases, with multiple email addresses, or on behalf of any other person. The Organizing Company reserves the right to verify identity by any means.

The act of entering the Contest implies full and unreserved acceptance of these rules. These rules are available free of charge on the U.S.-based website of the Organizing Company, available at the following web address: https://www.christofle.com/us_en/. The Organizing Company reserves the right to modify these rules at any time and to make any decisions that it deems necessary for the proper application and interpretation of the rules. The Organizing Company may notify entrants of such modifications by any means of its choosing. The Organizing Company also reserves the right to modify, extend, shorten, suspend, or cancel the Contest, without prior notice, due to any event beyond its control and, in particular, in the case of a force majeure event or act of God.

The liability of the Organizing Company is strictly limited to the delivery of the prizes effectively and validly won by the winner(s).

Access to and entry in the Contest do not confer any rights upon the entrants with regard to the intellectual property of the Organizing Company.

Entry in the Contest implies awareness and acceptance of the characteristics and limitations of the Internet, in particular as pertains to technical performance, response time for viewing, checking, or transferring data, the risk of service interruption, risks related to connectivity, the absence of protection of certain data from potential misappropriation, and the risk of contamination with any viruses that may be circulating online. Consequently, the Organizing Company cannot, under any circumstances, be held liable for issues including but not limited to: Internet malfunctions and any issue related to settings or browsers that leads to flaws in the administration, security, fairness, integrity, or management of the Contest.

The Organizing Company does not guarantee that the website https://www.christofle.com/us_en/, and/or the Contest, shall be in working order without interruption and free of  computer errors, nor that any recorded flaws will be corrected.

The Organizing Company cannot be held liable in the event of a technical malfunction of the Contest, if the entrants are unable to connect to or place an entry on the Contest website https://www.christofle.com/us_en/, if the data pertaining to a given entry does not reach the Organizing Company for any reason outside its purview or is illegible or cannot be processed, or in the event of email routing issues or any other issue related to telecommunications networks, online computers, servers, Internet access providers, or computer hardware or software. The entrants shall have no claim to compensation on such grounds.

Likewise, the Organizing Company shall not be held liable for any material or moral prejudice, whether direct or indirect, caused to entrants, their computer equipment, or to the data stored on their equipment, or for any direct or indirect consequences stemming therefrom. Connection to the Organizing Company’s website, https://www.christofle.com/us_en/, by any person, and the act of entering the Contest, occurs under the individual’s sole responsibility.

 

6/ PERSONAL DATA - PRIVACY

The data collected in the context of this Contest are necessary for consideration of your entry. These data are directed to the Organizing Company, which is the data processor, for purposes of managing your entry, selecting the winner(s), and awarding and delivering the prizes.

When entering the Contest, entrants may also subscribe to receive exclusive offers and information about new Christofle products via email from the Organizing Company. Data collected in this context may be used within this legal framework.

7/ DISPUTES

These rules are governed by French law. No response will be given to any request or claim made by telephone regarding the Contest or the interpretation of these rules. Any request or claim regarding the Contest and/or the names of the winner(s) must be addressed to us at: customer.service@christofle.com.

No objection or claim shall be considered one month after the closing of the Contest.

In the event of persistent disagreement as to the validity, application, or interpretation of these rules, and failing amicable agreement, any dispute shall be submitted to the competent court in Paris, France, to which exclusive jurisdiction is conferred, unless obligatory procedural rules provide otherwise.
